The Federal Trade Commission has settled claims against a debt collection company that used false and misleading statements to defraud consumers. Whitewing Financial Group, a Houston, Texas- based debt collection company, is accused of violating both the Fair Debt Collection Practices Act (FDCPA) and the Federal Trade Commission Act. The company and three co-defendants have agreed to a $150,000 fine and will refrain from committing similar acts of consumer fraud henceforth.

  • Misrepresenting the character, legal status, and amount of debts
  • Communicating with consumers at inconvenient times or places
  • Communicating with consumers without prior court permission or consent
  • Using false representations or deceptive means to collect or try to collect debts
  • Using misleading or false statements to obtain information from or regarding consumers
  • Threatening to take action that cannot be lawfully taken or that was not intended to be taken

The company purchased and attempted to collect on very old debts, which were, by and large, beyond statutory limitations and too old to appear on consumers' credit reports. Some had also been discharged in bankruptcy. The company sent validation letters as required by law, but then made contradictory and misleading statements over the phone to targeted consumers. The company pressured consumers to pay on these debts before they received proper notification, confused them about their legal rights, and more.
