State Sues Fraudulent Contractor

The State of New Jersey has filed a lawsuit against a home-improvement contractor claiming that he never completed work for which he was paid, and also performed work without registering with the Division of Consumer affairs as required by federal law.

“Instead of enjoying these home improvements, consumers were left with empty promises,” said Attorney General Stuart Rabner.

A History of Shady Practice

The contractor, known as The Shademaster, owned by Carmine Annunziata, built and installed awnings and sunrooms. It is the second contractor that has been sued in the past month for violating the Contractor's Registration Act. The law, enacted two years ago, requires contractors to register with the state to help protect their customers from unscrupulous business practices.

The Shademaster has been the subject of 16 complaints filed by customers with the Division of Consumer Affairs, and has also already been sued for violating the Consumer Fraud Act, said the state.

The new lawsuit claims that Annunziata:

  • Accepted money for home improvement projects that were never begun nor completed
  • Failed to refund complaining customers' money
  • Performed work while unregistered
  • Fraudulently attempted to obtain a construction permit from a city by claiming it had applied with the state

Annunziata filed for bankruptcy in October. He still owes $545,639 and has assets worth $235,200, according to Bankruptcy Court documents. Under Chapter 13, Annunziata can repay his creditors over the course of three to five years.
