Bogus Height-Enhancing Pills Targeted By FTC

The Federal Trade Commission has charged a Florida company and its owner with marketing a height-enhancing dietary supplement based on false and unsubstantiated claims. The business and its owner must pay $375,000 to settle the FTC charges.

According to the FTC complaint, the company advertised that the dietary supplements HeightMax Concentrate and HeightMax Plus:

  • Increase the height of users between the ages of 12 and 25 by as much as 2 to 3 inches over what they would grow without the product
  • Reduce the amount users' body fat and increase lean body mass
  • Cause a 10 to 25 percent gain in height after six months of use and a 20 to 35 percent gain with more than a year of use
  • Have been clinically proven for use in teenagers and young adults
  • Were created after years of clinical trials and research by William Thomson, an expert with a Ph.D. in Biochemistry

Sunny Health Nutrition & Technology Products, the maker of HeightMax, placed Spanish and English language advertisements in a number of magazines including Rolling Stone, Maxim, and Newsweek. The company also marketed its products on the radio and Internet.

The FTC complaint said the company's advertising claims were false, adding that William Thomson, the supposed expert, was invented by the owner to add credibility to the products.

Earlier this week, the FTC ordered the company to pay $375,000 in consumer redress for false claims related to HeightMax and two of its other products, Liposan Ultra Chitosan Fat Blocker and OsteoVite.
