The Federal Trade Commission (FTC) recently filed a lawsuit against Direct Marketing Concepts Inc. and ITV Direct for an infomercial that is reportedly misleading consumers.
The infomercial, which is filmed in Beverly, MA, states that consumers around the U.S. can easily lose weight while “eating anything and everything they want.”
The federal government says that the infomercials claims are false and they are now going to court to try and prevent the commercial from airing in the future.
Diet Book Makes False Claims
The FTC is targeting the companies' book, “The Weight Loss Cure They Don't Want You to Know About” in their suit.
In the infomercial, the book's author, Kevin Trudeau, reportedly tells audiences that the book's diet is simple and can easily be done from home.
However, according to the FTC, the diet is grueling and life changing with daily injections of prescription drugs needed to be effective.
“They have beer, they have cheese, they have butter, they have peanut butter and jelly sandwiches,” Trudeau says of those who are on the diet.
The FTC says that's as a result of the infomercial, consumers have suffered “substantial monetary loss and possible injury to their health.”
Not The First Time
The infomercial has reportedly aired on national cable networks since last January.
The FTC sued the company three years ago for making other deceptive claims regarding another dietary supplement program.
The company was allegedly billing consumers' credit cards without getting authorization.
