Consumers of several online retailers such as Priceline.com, Fandango.com, and Staples.com were allegedly victims of a credit card Internet scam in which they were fraudulently charged fees for a “discount club” membership they hadn't authorized, according to a Massachusetts class action lawsuit filed in federal court.
The suit accuses online marketing services company Webloyalty.com—which supplies millions of subscribers with discounts, rewards, and protection programs—of participating in a “coupon click fraud” scheme that involves the company illegally obtaining consumer credit card information without their consent or knowledge.
According to the lawsuit, when consumers purchased something from one of Webloyalty's partners such as Staples and clicked on the pop-window offering coupons for their next purchase, their credit card number and information was immediately transferred to Webloyalty.
The consumer would then be unknowingly enrolled in the company's “Reservation Rewards” program, which promises discounts and rewards, but also charges up to a $10 monthly fee.
“Hundreds, if not thousands of consumers have complained to Webloyalty and local, state, and federal consumer protection agencies about the deceptive nature of its sales of its ‘Reservation Rewards' discount club product and its unauthorized access to their credit card information,” the complaint stated.
The lawsuit also alleges that Webloyalty as well as several of its partners, which are named codefendants in the suit, are engaging in unfair and deceptive business practices and violating consumers' privacy rights by fraudulently disclosing their credit card information.
The class action suit seeks full compensation for all plaintiffs, an injunction on the claims, and other remedies.
