Unwanted Magazine Subscriptions Subject of FTC Charges

Several companies are being charged by the Federal Trade Commission with engaging in deceptive marketing practices. The companies are accused of luring consumers into signing up for unwanted magazine subscriptions that couldn’t be canceled.

According to the FTC, the defendants—known collectively as Magazine Solutions—violated Section 5 of the FTC Act and the Telemarketing Sales Rule. Specifically, the defendants are charged with:

  • Misrepresenting sales calls by telling consumers that they were only calling to conduct a survey when the calls were in fact a pitch for magazine subscriptions.
  • Offering consumers $1,000 worth of coupons, which were only given when consumers agreed to receive magazine subscriptions. In some cases, the FTC claims that consumers never even got the coupons.
  • Misrepresenting the costs and terms of the subscriptions, including the terms of the cancellation policy.

In its complaint, the FTC states that some consumers never agreed to the defendants’ offer but were still charged hundreds of dollars and harassed when they refused to pay for the “service.” When consumers failed to pay for the unwanted subscriptions, the defendants would report them to credit bureaus.

The FTC is seeking to freeze the defendants assets to compensate consumers. It is also seeking to permanently bar the companies from engaging in deceptive marketing practices.
