A class-action lawsuit has been filed against a mortuary where several decomposing bodies were found in a storage facility.
The suit was filed by David Wells, whose father's corpse was among the decomposed, against the Abbey Chapel of the Redwoods Mortuary, and its owned Anthony Villeggiante.
The Lawsuit
According to the suit, the mortuary and its owner were negligent in the care and disposal of nine decomposing bodies because they were not cremated in a timely manner.
Of the nine corpses, six were moved to another mortuary.
Rohnert Park officials had already made similar allegations against the mortuary. They had claimed that the corpses were not adequately refrigerated, and that the mortuary was storing bodies in one of its facilities without a permit.
The class-action suit has been filed on the behalf of at least 50 additional plaintiffs, who have remained unnamed. It claims the mortuary was guilty of fraud, negligence, intentional infliction of emotional stress, and breach of contract.
In addition to damages for the plaintiffs, the suit also seeks an injunction against the mortuary prohibiting it from ever operating in the city again.
A temporary injunction has already been granted.
The suit seeks a jury trial and the first hearing is scheduled for July 10. The plaintiffs seek compensation for shock, anguish, emotional stress, physical upset, and money paid to the mortuary for services that were negligently performed, and for putting the bodies in an appropriate resting place.
