Nintendo Hit With Class Action Lawsuit

A consumer fraud class action lawsuit has been filed against Nintendo over defective wrist straps on its Wii game controllers. The company has already agreed to replace more than 3 million of the defective straps.

The complaint cites “Nintendo's failure to include a remote that is free from defects” and further states that this failure is in breach of the company's product warranty.

The Issue

The plastic wrist strap – which is designed to prevent the wand-like controller from slipping out of a user's hands during lively games like tennis and bowling – is not strong enough.

Nintendo has received reports of broken windows, lamps, and televisions from users whose controller accidentally slipped from their hands while playing. The company said it plans to replace the defective straps with thicker, sturdier ones.

The Nintendo Wii game console was released last month. Nintendo said it expects to sell as many as 4 million consoles before the year-end.
