A Tennessee law firm representing three plaintiffs has filed a federal class-action lawsuit against a peanut butter manufacturer on behalf of all the people who got sick as a result of eating peanut butter contaminated with salmonella.
The suit, filed by lawyers for Grady and Francis Ware, and Ricky Bunn, names ConAgra Inc., manufacturers of Great Value, and Peter Pan peanut butter, as the defendant.
The Suit
“My wife and I both were really sick from eating this peanut butter that we thought was fine to eat. We hope nobody ever has to go through anything like this,” said Grady Ware. “We had diarrhea so bad that we both had to be in the hospital for two days and I still feel sick over a week later. I won’t ever eat peanut butter again, but I hope this lawsuit will make ConAgra make sure that all of its food products are safe for others.”
The suit aims to force ConAgra to preserve all documents and evidence relating to the discovery of the contamination, and the recall of the Peter Pan and Great Value peanut butter products that were produced in their Sylvester, Ga. plant.
The plaintiffs’ lawyers described the suit as a nationwide class-action lawsuit.
“We think it is important to protect every individual who has been harmed,” said one of the plaintiffs’ lawyers, Kathryn E. Barnette. “We want to make sure people are fairly compensated,” she added.
Barnette is unsure how much money the suit will produce. “We want full compensation for people, medical bills certainly. People missed work that I’ve talked to, some had had to find child care and there is very real pain and suffering,” she said.
The Claims
The three named plaintiffs claim that after eating Peter Pan peanut butter manufactured the ConAgra plant in Georgia, they were infected with salmonella.
“We don’t know the extent of it yet,” said Barnett.
This suit is one of the many amassing against ConAgra over its salmonella-contaminated peanut butter.
