New Jersey state has filed a consumer fraud lawsuit against Rite Aid, alleging the drug store chain charged consumers more than shelf price lists and sold expired goods including baby food, infant formula, and non-prescription drugs.
The suit seeks monetary compensation for consumers, civil penalties, and an order to the drug store to immediately stop the sale of all out-of-date products.
“It is unconscionable that a store would sell expired merchandise—especially infant formula, baby food, and non prescription medications—to unsuspecting consumers who rely on these products for the care and welfare of their loved ones,” said New Jersey Attorney General Stuart Rabner.
Violations of the Consumer Fraud Act
Between August 14, 2006 and October 2, 2006, state officials investigated nearly 104 Rite Aid stores in New Jersey.
According to the lawsuit, Rite Aid is charged with the following violations:
• Selling expired goods at about 42 Rite Aid stores
• Misrepresentations, deceitful commercial practices, and false promises
• Failing to post the refund policy at about 31 Rite Aid stores
• Charging consumers more money than the shelf listed price
• Improper price scanning at more than 76 stores
