Sears Sued for Violating Consumer Fraud Law

<< Back to News

A lawsuit was recently filed against Sears, Roebuck & Co. for allegedly compromising the private information of its customers.

The consumer privacy suit focuses on the company’s website which supposedly allows users to see the purchasing history of Sears customers.

Website Questioned
The suit claims that the company’s Manage My Home site enables consumers to view the purchase histories of previous Sears customers.

In violation of the Consumer Fraud Act, the purchase history can be viewed by entering the public information of customers such as their name and address.

The suit accuses Sears of being “deceptive” and “unfair.”

Since the suit was filed, a spokesman for retailer says the company has “turned off the ability to view a customer’s purchase history on Manage My Home until we can implement a validation process that will restrict access by unauthorized third parties.”

Suit Seeks Compensation
The suit is seeking millions in damages since the site could be illegally used to commit fraud and obtain personal customer information.

“There’s so many scary situations where people could easily trick you into getting more personal information or gain access to your home for improper purposes,” explains Jay Edelson, a partner at KamberEdelson LLC, the company that filed the suit.
