Lawsuits Filed
Paul Burnett is one of the 100 million Americans that are registered with the National Do Not Call Registry, which bans most telemarketers from calling people on the list.
When he received a telemarketer call one Saturday afternoon he decided to fight back and filed a complaint with the Federal Trade Commission.
“If you don’t fight back, nothing will change,” Burnett explains. “If you do fight back, something might happen.”
Burnett is among the many who decide to take action when hassled by telemarketers.
Bob Arkow has sued dozens of telemarketing firms and has collected about $25,000 under the Federal Communications Commission’s Telephone Consumer Privacy Act, which is another law regulating telemarketing.
“If you think you’re getting telemarketing calls illegally, use every resource at your disposal,” says Federal Trade Commission spokesman Mitch Katz. “We can’t go after every company in the country, but there are a lot of ways you can go about fighting back, if you will.”
The Facts
Telemarketing companies can be fined as much as $11,000 per illegal call by the Commission, and have in the past, notably winning $5.4 million in a settlement against DirectTV and other telemarketing firms working for DirectTV.
Although the National Do Not Call Registry has been successful in cutting down on the amount of people who receive unwanted telemarketing calls, in 2004 and 2005, 92 percent of those polled claimed they received calls after joining the registry.
