The Federal Trade Commission has outlined a number of rules to govern telemarketing sales practices in order to protect consumers. Since not all telemarketing is illegal, it is important for consumers to know the law and their rights. The FTC’s Telemarketing Sales Rule prohibits telemarketers from the following:

• Making calls before 8 a.m. or after 9 p.m.
• Lying about their goods or services, risks, prizes, profitability or earning potential, or liquidity of investment
• Withholding information about the nature of the sale including total costs, restrictions, nature of the sale (final or non-refundable), and/or other sales conditions
• Withdrawing money from your bank account without your express, verifiable consent
• Tricking you into paying
• Requiring payment before goods or services are rendered
• Calling you if you have asked not to be called

The FTC together with the Federal Communications Commission and state governments also enforces the National Do Not Call Registry. The federal government created the registry to give consumers some control over telemarketing calls they receive. Individuals who place their name on the registry may still receive some telemarketing calls, but most will be stopped. Those who wish to register may do so by calling toll-free, 1-888-382-1222 (TTY 1-866-290-4236) from the number they would like to register. You can also add yourself to the registry online at www.donotcall.gov. The registry accepts both cell and home phone numbers. The government provides the service for free.
